DTSC Fines Exide Technologies $102,300 For Hazardous Waste Violations
The California Department of Toxic Substances Control (DTSC) has issued an Enforcement Order to a Los Angeles area waste processor it alleges stored hazardous waste sludge in a storm water retention pond.
DTSC ordered Exide Technologies to cease storage of any hazardous waste or hazardous waste sludge in the Storm Water Pond, and to clean up hazardous waste that has accumulated there.
In its order, DTSC alleges that during a routine inspection at Exide's East Los Angeles facility inspectors discovered hazardous waste and lead-contaminated hazardous waste sludge in the company's storm water retention pond. DTSC also alleges that records subsequently submitted by Exide showed that the company only cleans out the pond once a year.
DTSC ordered the company to clean up any hazardous waste or hazardous waste sludge within 24 hours of it accumulating in the storm water retention pond, or as soon as practical.
The department assessed a penalty of $102,300 to the company for violations of California's Health and Safety Code.
According to the enforcement order, Exide Technologies must pay the entire fine within 30 days of DTSC entering the order.
